Welcome to Barry Bar. These Terms and Conditions ("Terms") govern your use of our automated bartending services, equipment rental, and related services. By accessing our website or using our services, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, please do not use our services.

1. Definitions

"Barry" or "We" refers to Barry Bar and our automated bartending systems.

"Client" or "You" refers to the individual or entity renting or using our services.

"Equipment" refers to the Barry automated bartending machines and related accessories.

"Services" refers to equipment rental, setup, operation support, and maintenance.

2. Service Agreement

2.1 Booking: All bookings must be made through our website or by contacting our team directly. A written confirmation is required for all service agreements.

2.2 Deposit: A non-refundable deposit is required to secure your booking. The deposit amount will be specified in your service agreement.

2.3 Payment Terms: Full payment is due prior to the event date unless otherwise agreed in writing. We accept major credit cards, bank transfers, and other payment methods as specified.

2.4 Cancellation: Cancellations must be made in writing. Cancellation fees apply based on notice period: 30+ days (deposit forfeited), 14-29 days (50% of total), less than 14 days (100% of total).

3. Equipment Use & Responsibilities

3.1 Proper Use: Equipment must be used only for its intended purpose and in accordance with our operating instructions. Clients are responsible for ensuring proper use by all event attendees.

3.2 Supervision: While Barry operates autonomously, responsible adult supervision is required during events to ensure safe and appropriate use.

3.3 Damage: Clients are responsible for any damage to equipment beyond normal wear and tear. Repair or replacement costs will be charged to the client.

3.4 Location Requirements: Client must provide adequate space, electrical power (specified in service agreement), level flooring, and protection from weather elements.

4. Liability & Insurance

4.1 Our Liability: Barry Bar maintains comprehensive liability insurance. We are responsible for equipment malfunction due to manufacturing defects or our negligence.

4.2 Client Liability: Clients are responsible for injuries or damages resulting from misuse, negligence, or failure to follow operating instructions.

4.3 Alcohol Service: Clients are responsible for compliance with all local alcohol licensing laws, age verification, and responsible service of alcohol. We are not liable for violations of alcohol service regulations.

4.4 Limitation: Our total liability shall not exceed the total amount paid for services rendered.

5. Alcohol & Beverage Service

5.1 Licensing: Client is responsible for obtaining all necessary permits and licenses for alcohol service at their venue.

5.2 Age Verification: Client must implement appropriate age verification procedures. Barry equipment does not verify age.

5.3 Beverage Supply: Unless otherwise agreed, client is responsible for providing all beverages, ingredients, cups, and garnishes.

5.4 Quality: We recommend using quality ingredients for optimal results. Barry Bar is not responsible for drink quality issues related to ingredient quality or storage.

6. Intellectual Property

6.1 Ownership: All intellectual property rights in Barry equipment, software, branding, and related materials remain the exclusive property of Barry Bar.

6.2 Usage Rights: Clients are granted a limited, non-transferable license to use our equipment during the rental period only.

6.3 Restrictions: Clients may not reverse engineer, copy, modify, or create derivative works based on our equipment or software.

7. Data Collection & Privacy

7.1 Analytics: Barry equipment collects usage data, drink counts, and operational metrics to improve service quality and generate reports.

7.2 Privacy: We do not collect personal information about event attendees. Our Privacy Policy governs the collection and use of client data.

7.3 Data Sharing: Usage data may be shared with clients for event analysis. We do not sell data to third parties.

8. Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to: natural disasters, acts of government, war, terrorism, labor disputes, pandemics, or equipment failure due to external causes.

In such events, affected parties will work together to reschedule or arrange alternative solutions. Deposits may be transferred to future bookings.

9. Warranty & Service Guarantee

9.1 Equipment Warranty: We warrant that equipment will be in good working condition at the start of rental. If equipment malfunctions due to our fault, we will provide replacement or refund as appropriate.

9.2 Technical Support: We provide technical support during events. Response times depend on location and availability.

9.3 No Other Warranties: Except as stated, equipment and services are provided "as is" without warranties of any kind, express or implied.

10. Termination

We reserve the right to terminate service immediately if: (a) client breaches these Terms, (b) equipment is misused or damaged, (c) illegal activity occurs, or (d) safety concerns arise. No refunds will be provided for termination due to client breach.

11. Governing Law & Disputes

11.1 Governing Law: These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

11.2 Dispute Resolution: Parties agree to attempt resolution through good faith negotiation. If unresolved within 30 days, disputes will be settled through binding arbitration.

11.3 Venue: Any legal action must be brought in courts located in [Your Jurisdiction].

12. Amendments & Changes

We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated effective date. Continued use of services after changes constitutes acceptance of modified Terms. Existing service agreements will remain under the Terms agreed at booking time.
